Imagine driving a car you thought was environmentally friendly, only to discover it’s been silently polluting the air more than you ever imagined. That’s the shocking reality for about one million Ford diesel car owners in the UK, according to a bombshell revelation in the High Court. But here’s where it gets controversial: despite knowing about the defects, Ford allegedly continued to produce and sell these vehicles between 2016 and 2018, with many never being recalled or fixed. During the trial, Thomas de la Mare KC grilled Marcus Davies, Ford’s former calibration manager, revealing that the issue affected ‘the best part of a million cars.’ While Davies downplayed the scale, claiming not all vehicles were impacted, the evidence suggests otherwise. Ford did introduce new software in 2018 and offered updates to some customers, but critics argue this was a Band-Aid solution. ‘It would improve it,’ Davies admitted, but de la Mare countered, ‘Not enough to comply with NEDC standards.’

The heart of the controversy lies in Ford’s alleged prioritization of test performance over real-world emissions. Internal documents from as early as 2012 show Ford was aware its exhaust gas recirculation (EGR) system wasn’t being used to its full potential to reduce NOx. Ben Jaffey KC, representing the claimants, pointed out that the system was ‘shaped to the requirements of the test and not much else.’ Davies conceded the calibration was partly tailored to NEDC tests, adding that optimizing for NOx would compromise the capture of other gases. But is this a justifiable engineering trade-off, or a deliberate evasion of environmental standards?

Another eyebrow-raising detail: Ford’s Euro 5 Transit vans were found to emit NOx far beyond regulatory limits when tested in sixth gear—a scenario encouraged by the vehicle’s gear shift indicator during real-world driving. ‘It’s hardly Grand Theft Auto, is it?’ Jaffey quipped, highlighting the absurdity of the situation. Models like the Mondeo, C-Max, Fiesta, Focus, and Transit vans are at the center of this scandal.

Ford vehemently denies creating defeat devices, labeling the claims ‘scientifically illiterate.’ Their defense? Reducing NOx control might be a necessary compromise to ensure system stability and prevent component damage. But does this argument hold up under scrutiny? The three-month hearing, which also examines vehicles from Mercedes, Renault, Nissan, and Peugeot/Citroën, aims to answer that.

This case echoes the infamous ‘Dieselgate’ scandal of 2015, when Volkswagen was caught using software to falsify emissions tests. Globally, millions of vehicles were affected, costing owners hundreds of millions of euros and, more tragically, contributing to thousands of deaths and asthma cases in children.
